Zu strafrechtlichen Themen ist i.d.R. deutlich weniger Literatur und Rechtsprechung auszuwerten. Zumeist handelt es sich um deutsche Literatur, die in jeder gut sortierten Unibib vorhanden ist.
Nachdem in den 80ern fünf Doktoranden das spannende Thema, ob eigenmächtiges Geldwechseln einen Diebstahl darstellt beackerten, steht mittlerweile die Frage, ob die eigenmächtige Entnahme von weggeworfenen Lebensmitteln (Containern) einen Diebstahl darstellt im Mittelpunkt der Forschung. Was macht man bei so einer Dissertation? 15 Lehrbücher zum Strafrecht BT, 20 Aufsätze und 10 Gerichtsentscheidungen auswerten?
Ich wollte mich mit der Aussage nicht über das Strafrecht lustig machen. Fakt ist aber, dass es deutlich weniger "neue" Themen als in anderen Rechtsgebieten gibt und dass nahezu jedes Problem und Scheinproblem in zahlreichen Abhandlungen dargestellt ist.
